Unless as expressly stated herein, INFRAREDCARE expressly disclaims all warranties, express or implied, of any kind with respect to products sold at this INFRAREDCARE.COM web sites. You agree that the only and exclusive maximum liability to INFRAREDCARE arising from any product sold on INFRAREDCARE.COM web sites shall be the price of the product ordered. In no event shall INFRAREDCARE, its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related into product sold.

ERRORS & OMISSION

INFRAREDCARE try our best to be as accurate as possible. However, we cannot guarantee that all product descriptions or other content of this web site is accurate, current, reliable, complete or free of error. If a product offered by us is not as described, your only remedy is to return it in unused condition and complete packaging.

In the event a product is listed with incorrect price or with incorrect information due to typographical error in pricing or product information received from suppliers, INFRAREDCARE shall have the right to refuse or cancel any orders placed for product listed at incorrect price or information. We, INFRAREDCARE also have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card is charged. If your credit card has been charged for the purchase and your order is cancelled by us, we shall immediately issue a credit back to your credit card account in the amount of the charge.

RETURNS or REFUNDS

Any compensation or refunds of cancellation order given to the customer will be refunded in a timely manner. Please allow 15 – 25 business days for the monies to be credited to your account.

Customer must notify or file a claim to INFRAREDCARE within 3 business days of order acceptance to notify any defects or mistakes discovered in the ordered products or the claim will be denied. In order to receive replacement of product, customer must return 100% of the received product within 10 business days (at customer’s own expense) from the time when the ordered was received by the customer. If return for replacement is accepted, a RMA (Return Merchandise Authorization) number will be issued and replacement will be mailed within 30 days provided we have that item in stock.

All charges related to expedite the service (rush printing or shipping) are NOT REFUNDABLE, including for those orders that are returned for any reason.

All returns must include original packaging. Do not cut out the UPC code, if there is any, or throw away the packing materials until you have examined and tested the product to your satisfaction. Removal of the UPC code and also return without full packaging will NOT be accepted regardless of RMA or credit request status. Original Packing List and Original Invoice have to be sent back to us with the return product. We do not accept any return without the Original Packing List and Original Invoice. Return must be completed with all accessories for that product including manuals, warranty cards, registration information, etc.

INFRAREDCARE in its sole and absoulte discretion shall be the sole determiner of whether a product is in fact defective.

UNDELIVERED PACKAGE

If the address you provided is undeliverable, we may contact you to verify your address for re-shipment. However, you should responsible for the additional shipping charges, any taxes, duties, or customs charges that are incurred on the package for both the original and the re-delivered shipment. We will NOT ship to P.O. Boxes.

TRANSFER OF TITLE

Our shipping terms are FOB Shipping Point, which means ownership transfers once we deliver any products to INFRAREDCARE'S shipping carrier. Any loss or damage that occurs during shipment by a carrier selected by us is customer's responsibility and customer should contact that freight carrier for claims of loss or damage.

INDEMNITY

You agree that you shall indemnify and defend INFRAREDCARE and all parties from whom INFRAREDCARE has licensed portions of content, and their officers, directors, and employees, against all claims, loss, damages, liability and costs and expenses, including reasonable legal fees and expenses arising out of or related to (1) your breach of these Terms and Conditions or (2) any claim, suit, loss or demand arising from or relating to any photograph, image, graphic, text or content or other material you incorporated into the products.

ORDER APPROVAL & SUBMITTED

Please review your order prior to submitting to us. We, INFRAREDCARE will not accept changes to orders that have been placed. We apologize for any inconvenience we may have caused. And customer has to check their orders before submitting to us.

ORDER SHIPPING

INFRAREDCARE will always try to make sure that any order will be shipped on time. In no case shall INFRAREDCARE be liable for any damages or loss or consequential resulting from any delay in shipment or delivery. All INFRAREDCARE customers agree not to hold us liable for delays in shipments caused by shipping company delays, weather conditions, international customs issues or any other circumstances beyond INFRAREDCARE’s direct control. We, INFRAREDCARE always act to make sure that delivery schedules are met.

INFRAREDCARE will only use our own shipping account and will NOT use customer provided account numbers for any couriers. Please note that we do NOT ship to P.O. Boxes.

When a package is NOT delivered due to an error made by the customer in submitting the proper shipping address when order is place, INFRAREDCARE will reship the package with corrected address and charge an additional shipping charge for that shipment.

SHIPPING ERRORS & LOST

Damaged or lost claims can only be filed for shipments over $50 in value and can only be done after 30 days from package shipment. We, INFRAREDCARE is NOT responsible for 3rd party shipping errors, damaged or omissions shipments.

Return Merchandise Authorization (RMA) Policy:

INFRAREDCARE will authorize a Return Merchandise Authorization (RMA) number to you. A quality Assurance representative from our company will contact you within 36-48 hours of your initial query to help issue your RMA number. Contact with our representative must be done within 3 business days to verify the request. INFRAREDCARE must receive the return package within 15 calendar days after our RMA number is issued. Compensation will be processed only after a RMA number has been issued and the entire product has been returned to us then the refund transaction will take place within 15 business days. Samples of the defective merchandise must be required prior to any resolution.
